At Uncappify, we take your privacy seriously. This Privacy Policy explains how we collect, use, protect, and share your personal information in accordance with South African law, particularly the Protection of Personal Information Act (POPIA).

1. Information We Collect

1.1 Personal Information

We collect personal information necessary to provide services, including: full name, email address, physical address, phone number, and identity document details (for RICA verification). This information is collected during registration and account setup.

1.2 Service Usage Data

We collect data about how you use our services: bandwidth usage, data consumption, connection logs, support tickets, and transaction history. This data helps us improve service quality, detect technical issues, and prevent fraud.

1.3 Device Information

For ISP services, we collect router MAC address, IMEI, device type, and network connection details. This information is used for service authentication, location verification, and technical support purposes.

1.4 Payment Information

Payment information is collected through secure payment gateways (Paystack). We do not store full credit card details on our servers. Payment data is encrypted and stored in compliance with PCI-DSS standards.

1.5 Automatically Collected Data

We use cookies and analytics to collect: browser type, IP address, pages visited, time on site, and user interactions. This helps us understand user behavior and improve our website and services.

2. How We Use Your Information

2.1 Service Delivery

Your information is used to: activate and maintain your account, provide technical support, process payments, deliver services, send service notifications, and complete identity verification (RICA requirements).

2.2 Communication

We use your email and phone number to: send billing information, service updates, maintenance notices, promotional offers (if opted in), and respond to support inquiries. You can opt-out of marketing communications at any time.

2.3 Fraud Prevention & Security

We analyze usage data to detect suspicious activity, prevent fraud, enforce our terms, and protect network security. This may include reviewing connection patterns and usage anomalies.

2.4 Service Improvement

We use anonymized data to: improve service quality, develop new features, understand user needs, and optimize network performance. Individual user data is not used for marketing analytics without consent.

2.5 Legal Compliance

We may use your information to comply with legal obligations, court orders, or government requests. We will disclose information to law enforcement or regulatory bodies as required by South African law.

3. Data Sharing & Third Parties

3.1 Network Providers

For ISP services, your data is shared with network providers (Vodacom, MTN, Telkom) who process data according to their own privacy policies. Review their privacy policies at their respective websites. We do not control their data practices.

3.2 Payment Processors

Payment information is shared with Paystack for transaction processing. Paystack operates as a data processor and is bound by their privacy and security policies. We do not store full payment details on our servers.

3.3 Hosting Providers

For web hosting and development services, data may be shared with hosting partners who operate our servers. All hosting partners are bound by data protection agreements and comply with POPIA requirements.

3.4 No Third-Party Marketing

We do not sell or share your personal information with third parties for marketing purposes. We do not authorize third parties to use your information for their own marketing without your explicit consent.

3.5 Business Transfers

If Uncappify is acquired, merged, or changes ownership, your data may be transferred as part of that transaction. You will be notified of any such change and given the opportunity to opt-out.

4. Data Protection & Security

4.1 Security Measures

We implement industry-standard security measures including: SSL/TLS encryption for data transmission, encrypted storage of sensitive data, regular security audits, firewalls, and intrusion detection systems. All data centers have physical security controls.

4.2 POPIA Compliance

We comply with South Africa's Protection of Personal Information Act (POPIA). We process data lawfully, ensure data accuracy, maintain data confidentiality, and provide individuals with access to their data upon request.

4.3 Data Retention

Personal data is retained only as long as necessary to provide services. ISP connection logs are retained for 90 days. Financial records are retained for 7 years (tax compliance). You can request data deletion after service termination.

4.4 Breach Notification

In the event of a data breach, we will notify affected individuals and relevant authorities within 72 hours as required by law. We will provide information about the breach, measures taken, and steps you can take to protect yourself.

4.5 Your Security Responsibility

You are responsible for: maintaining password confidentiality, logging out of accounts, notifying us of unauthorized access, and using secure devices. We are not liable for unauthorized access due to your negligence.

5. Your Privacy Rights

5.1 Access & Correction

You have the right to: access your personal data, verify its accuracy, request corrections or additions, and receive a copy of your data. Submit requests to support@uncappify.co.za. We will respond within 20 business days.

5.2 Data Deletion

You can request deletion of your personal data after service termination. We will delete data within 30 days except where: legally required to retain it, data is needed for dispute resolution, or deletion would impact other users' services.

5.3 Objection & Restriction

You may object to certain data processing or request restriction of processing. This may limit our ability to provide services. We will evaluate your request and respond within 20 business days with our decision.

5.4 Withdraw Consent

Where we rely on consent to process data, you may withdraw consent at any time. Withdrawal does not affect lawfulness of processing before withdrawal. Marketing communication opt-out is available in email footers.

5.5 Lodge Complaints

If you believe we violate your privacy rights, lodge a complaint with the Information Regulator: inforeg@justice.gov.za. You may also contact us at support@uncappify.co.za to attempt resolution first.

6. Cookies & Tracking

6.1 Cookie Usage

We use cookies to: remember login credentials, track user preferences, analyze website traffic, and improve user experience. Cookies are stored on your device with your consent. You can disable cookies in your browser settings.

6.2 Analytics

We use Google Analytics to understand how users interact with our website. Data is anonymized and used only for improving website performance. Review Google's privacy policy at policies.google.com/privacy.

6.3 Third-Party Cookies

7. Children's Privacy

7.1 Age Requirements

8.1 Updates to Policy

We may update this privacy policy to reflect changes in regulations or our practices. Material changes will be communicated via email 30 days in advance. Continued use of services indicates acceptance of updated policies.
