Welcome to Uncappify. These comprehensive Terms & Conditions govern your use of all Uncappify services including Internet Service Provider (ISP), Web Hosting, and Web Development services. By accessing or using any Uncappify service, you agree to be bound by these terms.

1. INTERNET SERVICE PROVIDER (ISP) SERVICES

1.1 Service Overview

Uncappify provides fixed wireless internet services through Vodacom, MTN, and Telkom networks. Services are delivered via high-quality routers and equipment designed for optimal performance and reliability.

1.2 Wireless Network Specifications

Our wireless packages are available through three network providers with varying speed capabilities: • VODACOM: 20Mbps, 30Mbps, 100Mbps (5G) - Uncapped Data • MTN: 10Mbps, 20Mbps, 100Mbps (5G) - Uncapped Data • TELKOM: 10Mbps - Uncapped Data All packages include professional-grade routers and 24/7 technical support. Advertised speeds are theoretical maximums based on optimal conditions. Actual speeds depend on device capabilities, router placement, and network congestion.

1.3 Coverage & Service Availability

Service availability depends on network coverage in your area. While we provide coverage checkers on our platform, actual coverage may vary based on terrain, weather, and network infrastructure. Service is provided on an "as-available" basis where coverage exists. You acknowledge that MTN, Vodacom, and Telkom Terms and Conditions are incorporated by reference into this agreement.

1.4 Fixed Location Service

Fixed Wireless Services are locked to your registered address via geo-location and IMEI locking. The SIM and router must remain at your registered location. Using the service outside this location will result in automatic suspension. Service must be returned to the registered location and verification requirements must be completed for reactivation.

1.5 Router Equipment & Responsibility

Professional-grade routers are provided with all packages. Routers remain the property of Uncappify. You are responsible for safekeeping. Damage, loss, or theft results in replacement charges (R3,000 charge). Routers must be returned in good condition if service is terminated.

1.6 Data & Uncapped Terms

All packages include uncapped data with fair usage policies. Once you reach monthly threshold limits (as per Acceptable Use Policy), connection speed is limited for the remainder of the month. No out-of-bundle charges apply. If you exhaust purchased data or reach fixed caps, you will be hard-capped with no further internet access.

1.7 ISP Service Suspension & Termination

Uncappify reserves the right to suspend or terminate services for: non-payment, violation of terms, unauthorized use, abuse of network resources, or illegal activities. Suspension may be immediate without notice for serious violations. Upon termination, you must return all equipment within 7 days.

2. WEB HOSTING SERVICES

2.1 Hosting Plans Overview

Uncappify offers DirectAdmin-based hosting plans with the following disk space options: • 1GB - R70/month (Basic) • 2GB - R105/month • 3GB - R135/month • 4GB - R165/month • 10GB - R330/month • 20GB - R590/month All plans include unlimited FTP accounts, email accounts, and MySQL databases. Plans are billed monthly with automatic renewal.

2.2 Hosting Features & Support

All hosting plans include: DirectAdmin control panel, SSL certificates (Let's Encrypt), daily backups, 99.9% uptime guarantee, email support, and DDoS protection. Technical support is available via email with response times within 24 hours. Premium support packages available upon request.

2.3 Data & Disk Space

You are allocated disk space according to your selected plan. You are responsible for monitoring your usage. Exceeding allocated space may result in suspension of services. Additional storage can be purchased at R25 per GB monthly. Automatic backups are retained for 30 days.

2.4 Hosting Service Suspension

We may suspend hosting services for: non-payment of invoices, violation of Acceptable Use Policy, malware distribution, spam hosting, or illegal activities. Suspension due to abuse may be immediate without notice. After 30 days of non-payment, accounts are terminated and data is deleted. Upon termination, you must migrate your data within 7 days.

2.5 Content Responsibility

You are solely responsible for all content hosted on our servers. You guarantee that all content complies with South African law and does not infringe on third-party rights. Uncappify reserves the right to remove any content that violates these terms without notice. You indemnify Uncappify against all claims related to hosted content.

2.6 Domain Management

Domain registration and management is handled through our partners. You maintain ownership of your domain. Upon cancellation of hosting, domain registration can be transferred to another registrar. Uncappify does not charge domain transfer fees. Domains must be renewed annually or they expire.

3. WEB DEVELOPMENT SERVICES

3.1 Web Development Service Types

Uncappify offers comprehensive web development services: • Landing Pages: R2,500 - R5,000 • Corporate Websites: R8,000 - R15,000 • E-Commerce Solutions: R12,000 - R50,000 • Custom Applications: R30,000+ • Website Redesigns: R8,500 • Maintenance & Support: R1,500 - R3,500/month Each package includes specific features, delivery timelines, and revision allowances as detailed in service descriptions.

3.2 Project Scope & Deliverables

Project scope is defined in the proposal and quotation. Changes to scope outside of included revisions will incur additional charges at R500/hour. Deliverables include source code, databases (where applicable), documentation, and deployment assistance. You receive ownership of custom code upon final payment.

3.3 Development Timeline & Revisions

Delivery timelines are estimates and depend on project complexity and client feedback timeliness. Revisions included in your package allow for corrections and minor modifications. Additional revisions beyond included allowance are charged at R500/hour. Client delays in providing feedback may extend project timelines.

3.4 Content & Third-Party Services

You are responsible for providing all content (text, images, videos). If we provide content creation services (additional cost), you grant us non-exclusive rights to use that content. Third-party integrations (payment gateways, email services, analytics) are subject to their respective terms and may incur additional fees.

3.5 Hosting & Maintenance Packages

Optional hosting and maintenance packages are available for all web development projects. Hosting includes secure servers, daily backups, SSL certificates, and email support. Maintenance packages cover security updates, performance optimization, bug fixes, and content updates. These are billed separately from development.

3.6 SEO & Performance

Basic SEO optimization is included in most packages. Advanced SEO services (keyword research, content strategy, technical SEO audit) are available as add-ons. Website performance optimization includes speed improvements, compression, caching, and CDN setup. Performance guarantees are subject to your hosting infrastructure.

3.7 Post-Launch Support

All projects include 30 days of post-launch support and bug fixes at no additional cost. Extended support is available through maintenance packages. Training on website management and CMS operation is included where applicable. Documentation is provided for all custom developments.

4. PAYMENT & BILLING

4.1 Payment Methods & Terms

We accept: EFT transfers, credit/debit cards (via Paystack), mobile money transfers, and direct bank deposits. Payment for ISP and Hosting services is due monthly in advance. Web development projects require 50% upfront deposit with balance due before delivery. Payment terms are strictly enforced.

4.2 Late Payment Fees

Late payment may result in service suspension. Invoices are due by the last day of the billing month. If payment is not received by end of month, services may be suspended without further notice. Reconnection fees of R500 apply. Repeated late payment may result in contract termination.

4.3 Promotional Cancellation Fees

Clients who subscribe to promotional packages (discounted rates, free routers, free months) and cancel within 6 months of activation are subject to a R999 cancellation fee. This is a fixed fee in addition to any other outstanding charges. Non-payment of this fee is treated as breach of contract.

5. DATA & PRIVACY

5.1 Data Collection & Protection

We collect personal data only as necessary to provide services. Your data is protected in accordance with POPIA (Protection of Personal Information Act) and international standards. We do not share customer information with third parties without consent, except where legally required by law enforcement or regulatory bodies.

5.2 Identity Verification (RICA)

For all ISP services, you must complete identity verification as required by RICA legislation. This includes providing valid identification documents. Failure to complete verification will result in service suspension. Your data is stored securely and protected according to RICA requirements.

5.3 Third-Party Provider Data Sharing

By using Vodacom, MTN, or Telkom services, you consent to their data collection and sharing practices. Uncappify does not control upstream provider data handling. Review their privacy policies at: MTN (www.mtn.co.za), Vodacom (www.vodacom.co.za), Telkom (www.telkom.co.za).

6. LIMITATION OF LIABILITY

6.1 Liability Exclusions

Uncappify is not liable for: service interruptions from any cause, network failure, equipment failure, data loss, business interruption, or indirect/consequential damages. Liability is limited to the amount paid for services in the past 12 months. Force majeure events (natural disasters, acts of God, government actions) are excluded from liability.

6.2 Third-Party Services

Uncappify is not liable for upstream provider actions (MTN, Vodacom, Telkom, payment processors, hosting partners). These entities provide services on "best effort" basis. Their suspension, modification, or discontinuation of services is beyond Uncappify's control and does not constitute breach of contract.

6.3 User Responsibility

You are responsible for: maintaining security of credentials, device safekeeping, proper router configuration, backup of critical data, and compliance with law. Failure to implement security measures or maintain equipment does not waive liability disclaimers. You indemnify Uncappify against claims arising from your negligence.

7. ACCEPTABLE USE & TERMINATION

7.1 Prohibited Activities

You agree not to: use services for illegal activities, harassment, spam, malware distribution, or content violating South African law. Excessive bandwidth usage impacting others may result in throttling. You may not resell services without written consent. Violations result in immediate suspension without refund.

7.2 Service Cancellation by Client

You may cancel services by providing written notice. ISP services cancelled before the 20th of the month are effective immediately at month-end. Cancellations on/after the 20th are effective at the next month-end. Web development projects cancelled mid-way are non-refundable for work completed. Hosting can be cancelled anytime with 7 days notice.

7.3 Termination Notice & Data Retention

Upon termination, you have 7 days to retrieve your data and equipment. After 7 days, data and accounts are deleted permanently. ISP equipment must be returned in original condition. No refunds are issued for partial months. All outstanding fees must be paid in full.

8. DISPUTE RESOLUTION

8.1 Resolution Process

Disputes shall first be handled through good-faith negotiation via email. If unresolved within 14 days, disputes may be escalated to mediation. These terms are governed by South African law. Any legal proceedings shall be conducted in the courts of South Africa, Western Cape jurisdiction.

Important Notice

By using Uncappify services, you acknowledge that you have read and understood these Terms & Conditions. Continued use of services constitutes acceptance of all terms. We may update these terms at any time with 30 days written notice. Your continued use after notice indicates acceptance.
